1. Eligibility

1.1 The giveaway is open to individuals who are 18 years of age or older at the time of entry.
1.2 Employees of Max Beach Resort, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouses, parents, children, and siblings) are not eligible to participate.

2. Entry

2.1 To enter, participants must complete and submit the official entry form available on the Max Beach Resort website.
2.2 Only one entry per person is permitted; multiple entries will result in disqualification.
2.3 All entries must be received by June 8, 2025 to be eligible.

3. Prize

3.1 The prize includes:

The Grand Prize consists of a two-night stay in a Two Bedroom Oceanview Residence at Max Beach Resort. Guests under 25 must be accompanied by an adult. Two Daytona Lagoon Waterpark Tickets which are available for use during the Waterparks seasonal times and dates. Two general admission tickets to the Tortugas Baseball Game subject to scheduled home game schedule. Two VIP tickets to the Star-Spangled Saturday night concert series at the Historic Bandshell available from Memorial Day weekend to the end of September each year. Two all day passes to Pictona Pickleball courts subject to their hours. Breakfast for two at Venn Bar Oceanside Eatery on property. Two-day complimentary beachfront cabana rental on Max Beach Resort property.

Second-Place Prize is a beachfront cabana for a day. Enjoy a relaxing day in an Oceanview Cabana at Max Beach Resort, designed exclusively for adults 21 and over. Accommodating up to eight guests from 9:00am to 6:00pm, this private retreat features comfortable sofa seating, sun loungers, a security safe, and a cooler stocked with ice and bottled water. Located just outside the pool gate, guests can enjoy dedicated service from The Venn Bar with food and drinks available for purchase, as well as access to the oceanfront pool, hot tub, and private access to the beach.

Third Place Prize is a Day Pass for Two. Spend the day at Max Beach Resort with access to the oceanfront pool and hot tub, lounge chairs (first come first serve), and our fully equipped fitness center featuring Technogym® equipment. Day Pass access is limited to adults 21 and over, and towels are not provided.

3.2 The stay must be booked within one year and used within 18 months of the drawing date. Subject to availability. Not valid on existing reservations, blackout dates, or during special events. The winner must follow the booking instructions provided on the prize certificate.
3.3 The prize is non-transferable, non-refundable, and cannot be exchanged for cash or any other alternatives.
3.4 Additional costs such as travel, meals, and incidentals are the responsibility of the winner. However, the $33 daily resort fee will be covered by Max Beach Resort.

4. Winner Selection

4.1 One winner will be randomly selected from all eligible entries.
4.2 The drawing will occur on June 9, 2025. Odds of winning depend on the total number of eligible entries received.
4.3 The winner will be notified within two days of the drawing via the contact information provided on the entry form.
4.4 If the winner does not respond within seven days, an alternate winner will be selected.

5. Publicity

5.1 By entering, the winner agrees to allow Max Beach Resort to use their name, likeness, and entry content for promotional purposes without additional compensation, unless prohibited by law.

6. General Conditions

6.1 Max Beach Resort reserves the right to cancel, suspend, or modify the giveaway if fraud, technical failure, or other issues affect its integrity.
6.2 Max Beach Resort may disqualify any individual found to be tampering with the entry process or acting in violation of these Terms and Conditions.
6.3 Any attempts to undermine the giveaway may result in criminal and civil penalties. Max Beach Resort reserves the right to seek damages to the fullest extent permitted by law.

7. Limitation of Liability

7.1 Max Beach Resort and related parties (“Released Parties”) are not responsible for any technical issues or inaccurate information caused by participants or systems involved in the giveaway.
7.2 By entering, participants release the Released Parties from any liability related to participation or prize use/misuse.

8. Governing Law

8.1 This giveaway is governed by the laws of the State of Florida, without regard to conflict of law principles.
